Distance Sales Agreement

This agreement is established to fulfill the legal obligation of entering into a contract for purchases made over the internet in accordance with the provisions of the Regulation on the Procedure and Principles of Distance Sales Contracts published in the Official Gazette No. 25137 on 13.06.2003. Accordingly,

ARTICLE 1 – PURPOSE

This agreement regulates the rights and responsibilities of the parties in accordance with the provisions of the Regulation on the Procedure and Principles of Distance Sales Contracts, related to the Consumer Protection Law (No. 4077), regarding the sale and delivery of the product sold by the SELLER to the BUYER. The characteristics and selling price of the product are provided below.

ARTICLE 2.2 – BUYER INFORMATION

The customer is a member of the excursion website www.excursionnest.com. The address and contact details provided during registration will be used as the basis for communication.

ARTICLE 3 – INFORMATION ABOUT THE PRODUCT SUBJECT TO THE AGREEMENT

This section includes the type, quantity, brand/model, color, selling price, and payment method for the product(s) or service(s) applicable when the order is finalized.

ARTICLE 4 – GENERAL TERMS

4.1 – The BUYER acknowledges and agrees that they have read and fully understood the preliminary information regarding the product’s basic features, selling price, payment method, and delivery details as specified in Article 3, and that the BUYER has provided the required confirmation in the electronic environment.

4.2 – The product(s) subject to this agreement should be delivered to the BUYER or the person/legal entity specified in the provided address within the timeframe established for each product based on the BUYER’s location, without exceeding the legal maximum of 30 days under any circumstances. This period may only be extended by 10 days, with prior notice to the BUYER.

4.3 – If the product is to be delivered to another person or entity other than the BUYER, Side Touristic Limited Company will not be held responsible if the recipient refuses delivery.

4.4 – VOYAWITH Turizm Limited Company is responsible for ensuring that the product(s) delivered match the specifications provided in the order, in good condition, and complete, along with any guarantee certificates or user guides, if applicable.

4.5 – In the event of delivery, if the product price is not transferred to VOYAWITH Turizm Limited Company due to the unauthorized use of the BUYER’s credit card by a third party without the BUYER’s consent, the BUYER is required to return the delivered product to VOYAWITH Turizm Limited Company’s contact address within 3 days. The return shipping cost will be the responsibility of the BUYER.

4.6 – VOYAWITH Turizm Limited Company will notify the BUYER in the case of failure to deliver the product within the specified time due to force majeure, adverse weather, transportation issues, etc. The BUYER will then be entitled to one of the following options: cancel the order, replace the product with an equivalent, or delay the delivery until the issue is resolved. If the order is canceled, the paid amount will be refunded in full to the BUYER within 10 days.

ARTICLE 5 – RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract within 7 days following the delivery of the product to the provided address. To exercise the withdrawal right, the BUYER must notify VOYAWITH Turizm Limited Company within this period via fax, email, or phone. The product must be unused, in accordance with the provisions in the relevant article. If the BUYER exercises this right, the carrier’s delivery confirmation showing the shipment of the product to the third party or the BUYER, along with the original invoice, must be sent to the contact addresses of VOYAWITH Turizm Limited Company. The product price will be refunded to the BUYER within 7 days of receipt of these documents. If the original invoice is not sent, VAT and other legal liabilities will not be refunded to the BUYER. The return shipping cost will be the responsibility of the BUYER.

Consumers may request the cancellation of a payment if the credit card or payment card has been used by unauthorized persons, illegally, and without their consent. In this case, the card issuer will return the payment to the consumer within 10 days following the objection notification.

For the enforcement of this contract, Consumer Courts located in the area where VOYAWITH Turizm Limited Company resides and the arbitration boards announced by the Ministry of Industry and Trade are authorized.

By placing an order, the BUYER is deemed to have accepted all terms and conditions of this agreement.
